These Terms & Conditions apply to all clients booking DJ services with NightStyle Disc Jockeys. By securing our services, the Client agrees to the following terms.
1. Performance Commitment
NightStyle Disc Jockeys will make every reasonable effort to fulfill its obligations under this agreement. However, in the event of unforeseen circumstances beyond our control—such as accidents, transportation issues, or other legitimate conditions—NightStyle Disc Jockeys reserves the right to either attend the event as scheduled or secure a suitable replacement at the agreed-upon fee.
2. Deposit & Cancellation Policy
To secure DJ services for a specific date, a non-refundable deposit of $500 is required. If the Client postpones the event, the deposit may be transferred to a new date within 12 months of the original booking, subject to availability.
If the event is canceled, the Client is responsible for the following cancellation fees based on the notice period:
90 to 60 days prior to the event – 50% of the booking fee (less the deposit).
60 to 30 days prior to the event – 75% of the booking fee (less the deposit).
Less than 30 days prior to the event – 100% of the booking fee (less the deposit).
3. Liability & Damage Responsibility
NightStyle Disc Jockeys shall not be held liable for any loss, damages, or liabilities arising from the services performed. The Client is not responsible for damage to the DJ’s equipment unless caused by blatant or malicious wrongdoing by the Client, their guests, employees, or other attendees.
However, the Client is responsible for any damages caused to the venue or DJ equipment by event attendees due to negligence, intoxication, or misconduct. If such damage occurs, the Client agrees to cover all repair or replacement costs.
4. Client Obligations & Event Conditions
The Client agrees to provide a meal for the DJ in the main reception area. If the event is designated as a "Rain or Shine"occasion, NightStyle Disc Jockeys’ compensation remains unaffected by inclement weather.
For outdoor performances, the Client must provide adequate overhead shelter to protect the DJ and equipment. If weather conditions pose a safety risk, the DJ reserves the right to pause or cancel the performance. In such cases, the DJ’s full compensation remains due.
5. Safety & Equipment Protection
If a situation arises during the event that poses a threat to the DJ, staff, or equipment, NightStyle Disc Jockeys reserves the right to pause or discontinue the performance. If the Client resolves the issue within 20 minutes, the DJ will resume performance. If the situation remains unresolved, the Client is still responsible for full payment.
To prevent equipment damage or liability, guests are strictly prohibited from accessing the DJ’s sound system, music recordings, or other equipment.
6. Setup & Technical Requirements
The Client must provide access to the performance area at least 1.5 hours before the scheduled start time for setup and sound balancing. A suitable electrical outlet and designated workspace must also be made available.
While NightStyle Disc Jockeys will make every effort to accommodate music requests, the availability and suitability of specific songs cannot be guaranteed.
7. Overtime Policy
All events must conclude no later than 1:00 AM. If the Client requests overtime, it must be negotiated directly with the DJ. Overtime will be charged at $300 per hour, in one-hour increments, and must be paid in full before overtime begins.
8. Payment & Collection
In the event of non-payment, NightStyle Disc Jockeys reserves the right to pursue collection through legal means. The Client agrees to cover all associated court costs, legal fees, and collection expenses. A fee of $45 will be charged for any returned cheques.
9. Media & Promotional Use
Throughout the event, photographs and video recordings may be taken for promotional purposes, including use on NightStyle Disc Jockeys’ website, social media platforms, and marketing materials.
10. Power & Technical Failures
NightStyle Disc Jockeys is not responsible for interruptions in service due to power failures, venue restrictions, or other technical malfunctions beyond their control. The Client is responsible for ensuring the venue has a reliable power source and necessary technical accommodations.
11. Music Restrictions & Content Guidelines
The DJ reserves the right to refuse to play music with explicit or inappropriate content if it is deemed unsuitable for the event or audience. If the Client has specific content restrictions, they must be communicated in advance.
12. Force Majeure Clause
Neither party shall be held liable for failure to perform due to acts of God, natural disasters, pandemics, government restrictions, or any other extraordinary events beyond their control. In such cases, both parties may negotiate a rescheduled event date without penalty.
13. Exclusive DJ Agreement (if applicable)
If the Client agrees to hire NightStyle Disc Jockeys for their event, they may not hire another DJ or competing music entertainment service for the same time slot unless otherwise approved.
14. Corporate & Private Event Distinctions
These Terms & Conditions apply to both corporate and private events. The Client is responsible for ensuring that all attendees and representatives comply with these terms. If the Client is booking on behalf of a company, organization, or third party, they confirm they have the authority to enter into this agreement on behalf of that entity.
15. Event Schedule & Timeline Compliance
The Client must provide a detailed timeline of the event, including any formalities (e.g., speeches, presentations, or awards) where DJ services are expected. NightStyle Disc Jockeys will make every effort to accommodate schedule changes but cannot guarantee last-minute alterations.
16. Third-Party Vendor Coordination
If the event includes other vendors, performers, or production teams, the Client must inform NightStyle Disc Jockeys in advance so that coordination can be arranged. NightStyle Disc Jockeys is not responsible for conflicts with other entertainment providers or technical issues caused by third-party vendors.
17. Venue Restrictions & Permits
The Client is responsible for ensuring the venue allows DJ services, amplified music, and lighting effects. If permits, noise restrictions, or venue-specific regulations apply, it is the Client’s duty to obtain necessary approvals. NightStyle Disc Jockeys is not liable for event disruptions due to venue restrictions.
18. Special Equipment & Additional Services
If the Client requires additional equipment (e.g., wireless microphones, projectors, specialty lighting, fog machines), they must request this in advance. Additional fees may apply for custom setups or extra services beyond the standard DJ package.
19. Governing Law
This agreement is governed by the laws of Ontario, Canada.
